We've written these terms to be clear and straightforward. By using Ubitel, you agree to these terms.
1. Introduction
These Terms of Service (“Terms”) apply to all agreements between Ubitel (“we,” “our,” or “us”) and you (“you” or “Customer”). You may only use Ubitel’s services if you accept these Terms.
These Terms are governed by the laws of Delaware, and any disputes will be resolved in the courts of Delaware.
2. Services
Ubitel provides prepaid eSIM data plans for travelers. We aggregate connectivity services from network partners worldwide and deliver them through our mobile app and website. Our eSIMs are data-only and do not include voice calls or SMS.
To use our service, you need an unlocked, eSIM-compatible device. You are responsible for verifying compatibility before purchase.
Service quality, coverage, and speeds depend on our network partners’ infrastructure and may vary by location.
3. Account
To use our services, you must create an account with accurate information and be at least 18 years old. You are responsible for keeping your account secure and your information current.
You agree to use your account solely for yourself and not share access with others. Ubitel is not liable for losses resulting from unauthorized access due to insufficient account security.
We may suspend or terminate your account if you violate these Terms or if we detect misuse.
4. Purchases and Pricing
eSIM prices are displayed at checkout in the indicated currency. Prices may change without notice. We accept payment via Stripe (credit cards, debit cards, and other methods Stripe supports) and supported cryptocurrencies as indicated on our platform.
By providing payment information, you confirm you are authorized to use that payment method. We are not responsible for fees charged by your bank or card issuer.
We reserve the right to refuse or cancel orders due to pricing errors, suspected fraud, or other reasons at our discretion.
5. eSIM Activation and Usage
eSIMs are delivered digitally. You are responsible for installing and activating your eSIM according to our instructions. Installation requires an internet connection.
Data plans activate according to the terms specified for each product (upon installation, first connection, or as otherwise indicated). Unused data does not roll over after the validity period expires.
6. Refunds
Refund requests are evaluated on a case-by-case basis. To request a refund, contact our support team within 30 days of purchase with your order details and reason for the request.
You may be eligible for a refund if: (a) you purchased an eSIM but have not installed or activated it; or (b) the eSIM fails to work due to an error on our part.
Refunds are generally not available if: (a) your device is incompatible or locked; (b) you no longer need the eSIM; or (c) you have already used data from the plan.
For cryptocurrency purchases, refunds are issued as Ubitel credits (UBI.C).
7. Rewards Program
Ubitel offers a rewards program with two types of rewards:
UBI.P (Points) are loyalty points that indicate your engagement with Ubitel. They are earned through activities like data usage and referrals. UBI.P are cosmetic and do not have monetary value.
UBI.C (Credits) are service credits that can be used to purchase eSIMs on our platform. UBI.C that you earn through purchases, referrals, or other qualifying activities can be transferred within the platform. UBI.C granted by Ubitel as promotional bonuses (such as onboarding credits) cannot be transferred, withdrawn, or converted.
Rewards have no cash value and no expiration date. We may change earning rates, redemption options, or program terms at any time.
8. Anti-Gaming Policy
Rewards are designed to incentivize genuine use of our services. Gaming — earning rewards through fake accounts, purchases with no intent to use, automated tools, or other abusive behavior — is prohibited.
We monitor on-chain transactions, wallet activity, and usage patterns to detect abuse. If we determine, in our sole discretion, that you have engaged in gaming, we may suspend your account, revoke rewards, and pursue other remedies.
9. Cryptocurrency Payments
We accept payment in supported cryptocurrencies as indicated on our platform. Exchange rates are determined at the time of purchase. We are not responsible for price volatility before, during, or after your transaction.
Blockchain transactions are generally irreversible once confirmed. We are not responsible for losses due to incorrect wallet addresses or other user errors.
We provide a wallet for users on our platform. You are responsible for maintaining the security of your wallet and account credentials.
10. Acceptable Use
You agree to use our services only for lawful purposes. You may not: engage in illegal or fraudulent activity; resell or redistribute our services; interfere with our systems or network partners; create multiple accounts to abuse promotions; or use automated tools to access our services.
Violation of this policy may result in immediate suspension or termination of your account.
11. Compliance
By using our services, you represent that you are not located in, or a resident of, any country subject to US sanctions, and that you are not on any US government prohibited party list.
12. Privacy
We handle your data in accordance with our Privacy Policy, available on our website. By using our services, you agree to our data practices as described in that policy.
13. Disclaimers
Our services are provided “as is” and “as available.” We make no warranties, express or implied, regarding reliability, availability, or fitness for a particular purpose.
Digital assets, including UBI.P and UBI.C, may have no value. We make no promises or guarantees regarding their utility or future availability.
14. Limitation of Liability
Ubitel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, resulting from your use of our services.
Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
15. Modifications
We may update these Terms from time to time. If we make significant changes, we will notify you in advance. By continuing to use our services after updates take effect, you agree to the revised Terms.
16. Termination
You may cancel your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use our services ends immediately, and any accumulated rewards may be forfeited.
17. Dispute Resolution
We hope to resolve any issues directly. If you have a concern, please contact us at support@ubi.tel before initiating any formal proceeding — most issues can be resolved quickly this way.
If we’re unable to resolve a dispute informally within 30 days, any claim arising out of or relating to these Terms or our services will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You may also bring a claim in small claims court if it qualifies.
Arbitration will be conducted in Delaware, or remotely if both parties agree. The arbitrator’s decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
18. Class Action Waiver
You and Ubitel agree that any dispute will be resolved on an individual basis only. You waive any right to bring or participate in a class action, collective action, or representative proceeding of any kind. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.
